Elder Law
The process of probate can seem complicated, but at Kepko & Phillips we will work with you to make it as simple as possible. We assist families and the elderly with wills and trusts, asset protection, Medicaid planning, and Ohio probate and guardianship procedures. Living wills and healthcare directives allow clients to state their wishes in advance. We also represent clients before the Social Security Administration, both with filing claims and appealing claim denials.
Mediation/Arbitration
Mediation services can help people resolve differences by working with the parties through a neutral attorney. Originally devised to help judges settle cases, the mediation process can be confidential if a private attorney is used, shielding your disputes from the public courts. We are trained in the art of mediation, and we can assist parties in resolving disputes before or during litigation.

Arbitration can also save court time and money. In one sense, it’s like going to court: each side may submit legal briefs, may take discovery, and usually will present live testimony. The biggest difference is that the parties have much more control over the arbitration process. They can agree to forego certain expensive aspects of litigation, and they can decide when the dispute will be heard. We offer complete arbitration services, including as a standard feature, full written opinions.
Litigation
Business or personal conflicts that cannot be resolved through mediation or arbitration often require attorneys with experience in both state and federal trials. Complex litigation requires thorough knowledge of business operations, the law, civil procedure, and litigation strategy. Our attorneys will effectively take on such challenges with skill and meticulous preparation. Our experience in commercial litigation covers a wide area. We have effectively handled matters involving breach of contract, breach of fiduciary duty, partnership disputes, covenants not to compete, employment disputes, real estate disputes, insurance disputes and healthcare fraud.
